A Federal High Court in Lagos on Thursday presided over by the Honorable Justice M.S Hassan has issued an interim injunction, restraining the National President of Association of Nigeria Licensed Customs Agents (ANLCA); Mr Tony Nwabunike and his executives from implementing the resolution of its recently held National Executive Council (NEC) meeting held in Abuja.
Part of the resolutions of the NEC meeting which held on 17th of December is the suspension of some key officers of the association in the western zone.
Respondents in the suit number FHC/L/CS/2155/2018 includes: the registered trustees of ANLCA, Tony Nwabunike and his company, MacTonnel Nigeria Limited, his vice, Kayode Farinto and Wealthy Honey Investment Limited, the National Secretary, Babatunde Mukhaila and Mickey Excellency Nigeria Limited.
Others are: the Financial Secretary of ANLCA, Hajia Bola Muse and Bomarah Investment Limited, Sweep Apple Services Limited, Dennis Okwu, Tesco Systems Limited, Uche Martins, Vita Laid Nigeria Limited and Joshua Ahuama.
The plaintiffs in the suit are; Integrated Coastal Services Limited and Mr. Thomas Edeigba.
The injunction restrained the respondents by themselves, their agents, privies, or whosoever howsoever from taking further actions on the resolutions reached at the purported NEC meeting held at the Barcelona Hotels Abuja pending the determination of the interlocutory application in the suit.
Justice Hassan stated that : "I have read the Applicants‘ application Ex Parte dated :19m December, 2018, the reliefs sought, the grounds of the application, the affidavit in support, including the Exhibits attached and the written address of Learned Counsel. The prayers sought in the instant application are hereby substituted with an Order of status quo ante bellium to be maintained in this suit pending the determination of the Motion on Notice"
"This Order of status quo ante shall be binding on all the parties in this suit"
"It is hereby ordered as follows;That status quo ante bellium be maintained hi! all the parties in this suit, pending the determination of the Motion on Notice.
That this suit is hereby adjourned to the 9th day of January, 2019 for hearing of the Motion on Notice".
