The prosecutor, Cpl. Kehinde Olatunde, said that the accused committed the offence on Dec. 4, 2009 at Shogunle, Oshodi.
He said that the accused stole the sum of N104, 000 belonging to one Mr Isimaila Mustapha.
Olatunde said that the complainant gave the accused N104, 000 to help him clear a 20ft container containing four vehicles at Tin Can Port, Apapa, Lagos.
He said that the accused collected the money since 2009 and was nowhere to be found.
“He disappeared to an unknown destination, without clearing the goods or returning the money.
“All efforts made to locate the accused proved abortive, as his phone numbers were no longer reachable," he said.
Olatunde said that the accused was arrested at Shogunle on April 3 after four years of seriously searching for him.
He said that the offence contravened Sections 285 of the Criminal Laws of Lagos State, 2011 and punishable with three years imprisonment.
The accused, however, pleaded not guilty to the charge.
The Magistrate, Mr Akeem Fashola, granted the accused bail in the sum of N50, 000 with one surety.
He adjourned the case till April 29, for mention.
