At the resumed hearing on Wednesday, both appellant and its counsel were absent due to failure of the court to serve notice of hearing on the appellant.
The acting chairman of the tribunal, Mr Nnamdi Ibegbu (SAN), said the appellant had at the last adjournment in March indicated interest in discontinuing the case.
“But up till now, no positive steps have been taken in that respect,’’ he said, adding that it was therefore necessary to serve the hearing notice on the appellant counsel.
He adjourned the case to Aug. 14 to enable the appellant to be served the hearing notice and for continuation or discontinuation of hearing.
