The Association of Nigeria Licensed Customs Agents (ANLCA) has threatened disciplinary action against its embattled Chairman of the its Board of Trustees (BoT); Alhaji Taiwo Mustapha for working against the rule regulation and law of the association.
Recall that the association has been in crisis over alleged expiration of the tenure of the Taiwo Mustapha-led BoT.
However, one month after the association organised an election to usher-in new board, the Taiwo Mustapha-led administration has refused to vacate office, claiming that their tenure has not expired.
The controversial board has also been alleged to have usurped the powers of the National Executive Committee (NECOM) of the association by conducting chapter elections at various western zone chapters.
The association’s NECOM has sent a letter to Alhaji Taiwo Mustapha on Tuesday, it was signed by the National Secretary; Alhaji Babatunde Mukaila.
A copy of the letter tittled: "Contravention of Rule, Order, Regulation/Law Of The Association" and which was obtained by our correspondent, also chronicled the alleged sins of the board chairman.
The NECOM alleged that actions taken by Taiwo Mustapha contravene the rule and regulation as prescribed in ANLCA constitution and also it is detrimental to the interest and rule of the association.
In the letter, the association requested Taiwo Mustapha to respond to the Chairman, Disciplinary Committee of the association in writing within 14 days, why disciplinary actions should not be taken against him.
The letter reads: "The Association has observed an action Committed dated 12 and 14" of January, 2021 where in a representative/servant of PYRAMID & ASSOCIATE MALLAM MUSTAPHA TAIWO perform a function of administering OATH OF OFFICE / ALLEGIANCE on purported newly elected executive members of Tin can Island, Murtala Mohammed Airport Cargo, Seme Border, Kirikiri Lighter Terminal, a prerequisite to function as a chapter Administrative Executives reference to section 11 SS.1c.
"Consequently, the function of Administering of Oath of Office and Allegiance as prescribed under section 31 of ANLCA Supreme Constitution is the prerogative function of the National President of the Association as it relates to Chapter Executive, reference to section 7 SS. 1a, 1g, and 1k.
"This action violates rules and orders as prescribe in ANLCA Supreme Constitution as amended and detrimental to the interest, rules and contraventions of the Association of Nigerian Licensed Customs Agent (ANLCA).
"Consequently, in accordance to Section 24 SS.3, you are to respond in writing within14 days on the receipt of this letter to the Chairman Disciplinary Committee of the Association, why your corporate membership of the Association should not be disciplined or punished in accordance with ANLCA Supreme Constitution under section 24.
"Association is not unmindful of your right and privilege to defend yourself in accordance with provisions of ANLCA Supreme Constitution”.
