Dismissed Customs Officer Wants Court To Declare His Dismissal Illegal

A dismissed staff of the Nigeria Customs Service, Mr Ishaku Wesley has asked the National Industrial Court (NIC) to declare his dismissal illegal on the ground that due process was not followed.
Ishaku told the court that he joined the services of the defendant on January 1, 1988 and had been carrying out his official duty until his dismissal in 2011.
He alleged that the normal procedure of terminating one’s appointment on medical ground was not followed.

Ishaku told the court that he joined the services of the defendant on January 1, 1988 and had been carrying out his official duty until his dismissal in 2011.
He alleged that the normal procedure of terminating one’s appointment on medical ground was not followed.
“They did not follow the proper procedure of constituting a medical board to examine my situation before dismissing me as it is the practice in Customs,” he said.
Ishaku told the court that he sustained an injury that led to his dismissal while on official duty through a gunshot.
He explained that it was his own colleague that accidentally fired the shot that removed one of his fingers while on duty somewhere in Ogun in 2010.
Ishaku further explained that the defendant did not take care of his medical bills and that the dismissal was carried out while he was still undergoing treatment.
He urged the court to either declare that the dismissal was unlawful and he be recalled or order the defendant to pay all his entitlements from the time of dismissal till his retirement period.
The Counsel to the defendant, Mr Lekan Ogunleye, told the court that the defence would field witnesses
The presiding Judge, Justice Oluseun Shogbola, adjourned the case to March 6, for continuation of the defence’s case.
