A witness, Dr Nanman Nandang, told the National Industrial Court    yesterday that the Nigeria Customs Service (NCS) dismissed a former employer, Mr Wesley Ishiaku, for losing two fingers of his right hand in a gun accident.
Nandang, an Assistant Controller of Customs, made the statement during cross-examination at the National Court.
Led in evidence by Mr Ezekiel Ugochukwu, counsel to Ishiaku, the witness said that NCS, dismissed the claimant because he was “no longer fit to work''.
Nandang also told the court that he examined Ishiaku and discovered that he was missing two fingers.
When asked by Ugochukwu whether he conducted a proper medical examination on Ishiaku  before he was dismissed, Nandang said he did.
Ugochukwu also asked the witness whether he consulted the doctor who treated his client before the decision to terminate his appointment was taken; the witness said he never did.
The plaintiff; Ishiaku had dragged the Nigeria Customs Service Board and the Comptroller-General of Customs to court, challenging his dismissal.
Ishiaku in the suit prayed the court to hold that his dismissal from the service was unlawful.
He alleged that the normal procedure of terminating appointments on medical grounds was not followed by the defendants before he was dismissed in 2011.
He also urged the court to declare that he should be recalled immediately.
He also wants an order of court, compelling the NCS to pay all his entitlements from 2011 till judgment was delivered.
Justice Oluseun Shogbola adjourned the case to April 29 for continuation of cross-examination.
