Master of APL England Faces Trial for Operating Unworthy Ship

The Captain of the APL ENGLAND is facing charges resulting from the cargo spill in May 2020. The charges are filed by the Australian Maritime Safety Authority and are in relation to the Captain approving the operation of an unseaworthy ship. The captain, Mohd Zulkhaili Bin Alias, a Malaysian national, is currently on bail in Malaysia awaiting a trial date. He appeared at a court in Brisbane via a video link from Malaysia on Monday.

The ship was traveling from Ningbo, China to Melbourne, Australia, and was grossly overloaded. Upon encountering gale-force winds and rough seas 46 nautical miles southeast of Sydney it lost containers into the ocean. Officers later determined that 50 containers were lost and 63 more were damaged. 23 containers of those that were lost were empty, but others contained dry powder fire extinguishers, face masks, shields, furniture, and other goods. The prosecution had initially framed charges on these very grounds, namely; disposing of garbage in the sea, in the exclusive economic zone, failing to ensure the operation of vessels such that there is no environmental damage. The charge of disposing of garbage was later rescinded by the judge due to insufficient evidence.

The Australian Maritime Safety Authority, highlighted heavily rusted lashing eyes, lashing bridges, and corroded deck structures in their initial findings report. Which no doubt contributed to the mishap. The cargo itself later washed up on NSW beaches.
